Terms of Service — WeddingComet

        Important Notice: Using the WeddingComet platform (the "Service" or
        "Platform"), including requesting access, creating events, entering data, and submitting
        RSVPs, constitutes your complete and irrevocable acceptance of these Terms. If you do not
        agree to these terms, you are not authorized to use the system.
      

1. Nature of Service & Limited License

1.1 WeddingComet provides software infrastructure for managing guest lists, RSVPs, seating arrangements, gift registries, and event teams.

1.2 The operator grants you a limited, non-exclusive, revocable, non-transferable license to use the Service solely for managing your events in accordance with these Terms.

2. "AS-IS" Provision & Disclaimer of Warranties

Operational & Technical Disclaimer: The Service, all reports, templates, data calculations, and associated tools are provided strictly "AS IS" and "AS AVAILABLE" without warranty of any kind, either express or implied.

2.1 The operator does not warrant that the Service will operate without uninterrupted uptime, errors, or bugs, or that it will be entirely immune to security breaches, cyberattacks, network outages, or data loss.

2.2 Independent Backup Obligation: You bear sole responsibility for maintaining independent backups of all guest lists, seating data, and event records.

3. User Status & Data Ownership (Data Controller)

3.1 Data Controller: The event organizer is the sole Data Controller regarding all personal guest data, phone numbers, names, and attendance records entered into the Platform.

3.2 Guest Consent & Spam Compliance: You warrant that you have obtained all necessary lawful consents from your guests to collect their data and send them event communications (via WhatsApp or SMS).

3.3 Data Processor: WeddingComet acts strictly as a technical Data Processor executing automated event workflows on your behalf.

3.4 Event Organizer Responsibility for Invited Team Members & Authorized Users: When an Event Organizer invites, authorizes, or grants WeddingComet access to team members, co-managers, assistants, or other users for the organizer's event:

The Event Organizer is solely and entirely responsible for selecting those users, assigning and managing their access permissions, and revoking access when appropriate;
Those invited users act strictly under the Event Organizer's direct authority and authorization in relation to that event;
The Event Organizer bears full responsibility for their use of WeddingComet in connection with the event, including all actions they perform, records or personal data they access, modify, import, or enter, and their compliance with these Terms and applicable legal obligations.

4. Limitation of Liability

4.1 Under no circumstances shall the operator, affiliates, or infrastructure providers be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including without limitation:

Loss or corruption of data, guest lists, or gift logs;
Unintentional data leakage, unauthorized access, or cyberattacks;
Undelivered SMS messages, messaging app blocks, or RSVP submission failures;
Seating misallocations, guest count discrepancies, or event schedule issues;
Emotional distress, loss of goodwill, or event disruption costs.

4.2 In jurisdictions where liability cannot be entirely excluded, total aggregate liability shall be limited to the amount paid by the user in the preceding 3 months, or $15 USD (50 ILS) if used without charge.

5. Indemnification

You agree to defend, indemnify, and hold harmless the operator and affiliates from and against any claims, damages, liabilities, costs, and expenses (including attorney fees) arising from your breach of these Terms, third-party/guest disputes regarding message delivery or data collection, or violation of applicable privacy laws.
